TENTATIVE DRAFT ORDINANCE PREPARED FOR DISCUSSION OF PRINCIPLES

1946.

An Ordinance to make provision for the constitution of a Port

Trust; to provide for the exercise and discharge by such Port Trust

of certain powers, authorities, duties and functions of the Harbour

Master; to confer and impose certain other powers, authorities, duties

and functions on such Port Trust; and for purposes connected there-

with.

Be it enacted by the Governor of Hong Kong with the advice and

consent of the Legislative Council thereof, as follows:

(1) This Ordinance may be cited as the Hong Kong Port

Trust Ordinance, 1946.

(2) This Ordinance shall commence on a date to be appointed

by the Governor and notified by proclamation published

in the Gazette.

(3) This Ordinance is divided into Parts, as follows:-

Preliminary.

Constitution of the Hong Kong Port Trust.

Powers, Authorities, Duties, Functions, and Obligations

of the Hong Kong Port Trust.

Finance, Accounts and Audit.

Miscellaneous.

Schedules (to be prepared in Hong Kong).

2.

(1) In this Ordinance unless the context or subject matter

otherwise indicates or requires:-

(a) "Port Trust" shall mean the Hong Kong Port Trust as

constituted by this Ordinance.

(b) "Dook" shall include all basins, cuts, quays, wharves,

warehouses, tramways, railways and other works and things

erected on or appertaining to any dock.

"Goods" shall include wares and merchandise and products

of the earth of every description.

(d) "High water mark" shall mean the line of the medium tide
